Terms and Conditions

Bee the Wellness, LLC (“we”, “us”, “our”, and “Bee the Wellness”) provides travel services that allow our clients to find the right physician to meet their healthcare needs in Buenos Aires, Argentina. The term “you,” “client” or “patient” refers to the client booking the travel services through us.

 

CONTRACT

Please read the following Terms and Conditions carefully.  These Terms and Conditions together with our privacy policy, release, the terms and conditions of our suppliers, and any other documentation we provide you form the basis of your contract with us  (collectively the “Agreement”).  This Agreement effects your legal rights, including waivers of liability, class action waivers, choice of law and venue and notice clauses, so we advise you to read it carefully.  By booking medical travel with us, you are accepting and consenting to the Agreement and all terms and conditions contained herein. By making a booking you indicate that you have read, understood, and agree to be bound by these Terms and Conditions, and that you understand and intend this Agreement to be the legal equivalent of a signed, written contract between you and Bee the Wellness, and equally binding. If you disagree with any of the Terms and Conditions, then you shall not book with us.

If you are making travel reservations or bookings for another person, you acknowledge and agree that you have provided these Terms and Conditions to each individual over the age of 18 (and all parents or guardians for any minor client) for their review and approval prior to making a travel reservation or booking with us. We will not be responsible for your failure to share the Terms and Conditions with all persons traveling under the reservation.

You agree to be financially responsible for all bookings you make. You are responsible for any bookings and medical travel reservations made by persons under your direction or control. You also warrant that all information supplied by you or on your behalf, or by members of your household is true, current, complete, and accurate.

 

Changes in the Terms and Conditions

Bee the Wellness reserves the right, in our sole discretion, to change these
Terms and Conditions at any time. Updated versions of the Terms and Conditions will be posted on our website and are effective immediately on posting. If we make material changes, we will notify you. Please check frequently, especially before you make a booking, to see if the Terms and Conditions have changed. Your continued use of our services, including continuing to use or maintain any bookings after any changes to the Terms and Conditions constitutes your consent to the changes.

 

Description of Service

Bee the Wellness is a medical travel provider for those seeking medical and health treatment for the following:

  • Hair Transplants
  • Fertility Services

Physicians in our network are specifically chosen to meet very high-quality standards and expectations. Our uniquely designed program ensures triangulation of care incorporating your local home physicians and the doctor you are seeing in a shared decision-making with you. We liaise with our partner medical service providers to obtain clients a free quote on the cost of their proposed treatment, as well as help book all the clients’ travel needs to ensure they are fully looked after during their trip.

 

Not a medical service provider

Bee the Wellness is not a medical service provider and as such we will never provide direct advice on a client’s treatment. Bee the Wellness does not control or operate any medical facility or treating institution within the medical travel destinations. Bee the Wellness is a medical travel facilitator, and we only suggest high-quality hospitals, treatment centers, and clinics that have been vetted by us, however, it is up to the client to choose which medical service provider is right for them. We only work to help link the client to high-quality licensed medical service providers and help to coordinate the client’s accommodations including, but not limited to, airport transfers, hotel accommodations, and transportation to/from appointments. Any medical treatment plans given will never be from Bee the Wellness, only from a licensed doctor. Bee the Wellness accepts no liability for any advice given by any third-party licensed doctor(s) or hospital(s) and we always recommend that clients consult their local doctor to discuss the treatment options given to them. Bee the Wellness cannot be made responsible for any delay, default, failure, improper services, deficiency in services provided by the medical service provider and/or for any injury, accident, death, sickness, discomfort, emotional pain or suffering, loss, or damage of any kind whatsoever, which may arise due to any act of negligence, deficiency, or default in services, of the medical service provider, management or employees of the medical service provider.

 

medical service providers/Institutions

The medical service providers and their institutions or affiliated institutions (collectively “medical service providers”) shall be solely responsible for all treatment to be provided by it to the client, including but not limited to, surgical, medical, wellness, fertility, beauty, and all related queries, opinions and complications and Bee the Wellness shall not be responsible for the same.

Any emergency, complication, or medical requirement, of whatsoever nature, arising with regard to the client’s treatment due to the patient’s present or past illness or the side effects / allergy of / to drugs or lack of adequate treatment, pre, during, or post treatment will be the absolute responsibility of the healthcare and medical service providers, and Bee the Wellness shall not be responsible for the same.

If the patient (and his/her family members, relatives, or friends making the booking on behalf of the patient) has any complaint in respect of the services rendered by the medical service providers, patient should forward such grievances directly to the medical service providers without any recourse to Bee the Wellness.

In case of medical discrepancy or conflict for immutability of malpractice carried out by the patient, all the concerned parties establish and agree that all judicial action must be carried out by the patient towards the medical service provider(s) only within the jurisdiction where the event occurred. Any legal action against medical service provider(s) shall not be extended towards Bee the Wellness, its managing companies, parent, subsidiaries, employees, agents or assigns, as Bee the Wellness is a company that puts at the disposition of the patient different professional options through listing their services without exercising or practicing medicine professionally.

 

Disclaimers

All information provided on the Website or through direct communication with Bee the Wellness is intended as a guide only and shall not be construed as a substitute for professional medical advice and Bee the Wellness makes no representations, warranties, or undertakings as to the accuracy of any information provided.

The institution and medical service provider providing treatment shall be completely responsible for all the treatments, opinions, and medical advice. Bee the Wellness will not be accountable or held responsible for the same.

Bee the Wellness shall not be accountable or held responsible for any information that the patient or his/her relative chooses to withhold with regard to past medical history during or after treatment. Bee the Wellness will also not be accountable or held responsible for the instances wherein the treating medical institution chooses to not solicit this information from the patient beforehand.

Bee the Wellness shall not be accountable or held responsible for any complications, emergencies, or medical requirements that may arise during or after treatment as it is the responsibility of the treating medical institution to handle this.

Please be aware that all medical procedures have risk attached to them and in the case of hair treatment therapy and fertility treatments, there may be an element of dissatisfaction with the final outcome. All procedures should be thoroughly understood and please seek clarification if there is any aspect that you do not understand. We shall not be liable or responsible for any dissatisfaction you may have from the medical services provided.

 

COVID-19 Release of Liability

By booking travel at this time, you acknowledge the highly contagious nature of COVID-19 and voluntarily assume the risk for yourself and any minors traveling with you, that you or they may be exposed to or infected by COVID-19 by traveling and that such exposure or infection may result in personal injury, illness, permanent disability, and death even if such injuries or losses occur in a manner that is not foreseeable at the time you book your trip. You acknowledge that exposure to such viruses or disease is an inherent risk of traveling, that cannot be controlled or eliminated by Bee the Wellness.

You acknowledge that your travel may be postponed or canceled, or changes may be made to itineraries due to closures of certain sites or activities, for which there may be no refund. You may also be required to quarantine upon arrival in some locations. Some locations may require you to have a vaccination or proof of negative testing. Stopover countries requirements will also apply. On your return home, additional testing, requirements, or documentation may be required.  You are responsible for understanding these requirements and must not rely on Bee the Wellness to provide these details. You understand that you may become sick before, during, or after the retreat and may not be able to travel and such cancellation or interruption will be subject to our cancellation terms below, for which we will not be liable.

You agree that due to uncertainty caused by COVID-19, Bee the Wellness has strongly encouraged the purchase of travel protection coverage including cancel for any reason coverage if and when available, and that should you fail to purchase travel protection coverage, Bee the Wellness shall not be liable to any losses how so ever arising. We are not liable should your travel protection plan not cover COVID related illness or injury.

You, for yourself, and any minors traveling with you, and on behalf of your and their heirs, assigns, personal representatives and next of kin (The Releasors), HEREBY RELEASE, AND HOLD HARMLESS Bee the Wellness, its members, officers, agents, and/or employees, suppliers, medical service providers (RELEASEES), of from and against any and all claims, damages, demands, losses, and liability arising out of or related in any way, in whole or in part  to any POSTPONEMENT, CANCELLATION, CHANGES, INJURY, DISABILITY, DEATH OR ANY OTHER LOSS you may suffer due to exposure, infection, spread, closure, and travel restrictions related to COVID- 19, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law. The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

 

Booking/Payments

To contact us regarding medical travel, please complete the contact us form on our website or email us at [email protected]. Upon receipt of your inquiry, we will reach out to you for a complimentary consult call to discuss your needs. Following the consultation, we will introduce you to the hair or fertility clinic(s) where you will have the ability to consult with the surgeons to determine the proper medical treatment and procedures an the appropriate treatment plan(s). After meeting with the surgeon you will receive a medical proposal from the medical service provider(s) that will outline the medical treatment plan you discussed with them. If you agree to the treatment plan and the medical service provider(s) and would like to move forward with travel to Buenos Aires to undergo the treatment plan, we will work with you and the medical service provider(s) to facilitate the proper travel arrangements including, but not limited to, airport transfers, hotel or resort accommodations, and medical procedure and appointment transfers. We do not book airfare. Once you have agreed to have us book particular arrangements, we will send you your proposed itinerary along with additional forms that must be reviewed, completed, signed, and returned to us to acknowledge your acceptance of the Terms and Conditions, and any Supplier terms and conditions.

You will receive an invoice with payment instructions. This invoice will include the total price for your travel arrangements and our planning fee and a separate total price for your medical treatments pursuant to your agreed upon medical treatment plan with your medical service provider(s). We will pay all travel accommodations and medical treatment payments by utilizing your credit card authorization to directly pay the Supplier(s) and your medical service provider(s). Under some circumstances, we will process your payment via a third-party payment processor (i.e. Stripe) for your medical treatments or any Supplier instead of directly paying the Supplier with your payment information depending on payment processing protections and the capabilities of any Supplier to collect payments.  Bookings must be paid for in full at the time of booking. If we do not receive any payment due in full and on time, we reserve the right to treat your booking as canceled by you in which case the cancellation charges set out below will become payable. We reserve the right to refuse a booking without giving any reason and shall in that event return any deposit received.

 

Credit Card Bookings

While we do accept major credit cards including Visa, Mastercard, American Express, and Discover, clients must provide to us a click authorization for every transaction for their travels. Your authorization is an agreement for us to charge your card and an acknowledgment and agreement to these terms and conditions including the cancellation terms. As such you agree not to make any improper chargebacks.

In certain cases, you can dispute charges with credit card companies (“chargebacks”). Before initiating a chargeback, we ask you first to call us to discuss any questions or concerns about our charges. We will work with you in attempting to resolve your concerns. By using our service to make a reservation, you accept and agree to our cancellation policy. Bee the Wellness retains the right to dispute any chargeback that is improper and recover any costs, including attorney’s fees related to improper chargebacks. Additionally, in the event of an improper chargeback, we retain the right to cancel any travel reservation related to that improper chargeback. The following chargeback scenarios are improper, and we retain the right to investigate and rebut any such chargeback claims:

  • Chargebacks resulting from non-cancellable reservations, whether or not the reservation is used.
  • Chargebacks resulting from charges authorized by family, friends, associates or other third parties with direct access to your credit card. This does not include credit card fraud.
  • Chargebacks arising from inconsistency or inaccuracy with regard to the supplier’s product description.
  • Chargebacks resulting from force majeure or other circumstances that are beyond the control of Bee the Wellness Travel or the Supplier.
  • Chargebacks resulting because you do not agree with the cancellation policy.

 

Prices and Rate Changes

The price of your itinerary will be based on known costs at the date of issue of the itinerary.  All prices we advertise are accurate at the date published, but we reserve the right to change any of those prices from time to time.  Prices include a cost for local taxes that are estimated at the date of publication.  At the time of final payment, we will provide you with an invoice reflecting the current price.

We reserve the right to make changes to and correct errors in advertised prices at any time before your travel is confirmed. We will advise you of any errors of which we are aware and of the then applicable price at the time of booking.

 

Planning Fees

Bee the Wellness’s compensation is derived from planning fees and commissions paid by our suppliers. The trip planning fees compensate us for the time and research involved in the planning process. You acknowledge and accept that travel planning fees are non-refundable under any circumstance while Supplier commissions are subject to the supplier terms and conditions.

 

Client Information

Names provided to secure reservations must match client’s passport. While we do not book airfare, it is imperative to understand that date of birth and complete passport details are required. Any minor name corrections advised after airline tickets have been issued will incur fees from the air carrier. Not all name corrections will be permitted by airlines and may require the purchase of a new ticket. Clients voluntarily assume full and sole responsibility for any and all risks and/or costs involved with their failure to correctly input identification information into any forms, or other documentation.

 

Supplier Terms & Conditions

Bee the Wellness, and its employees, shareholders, agents, and representatives use third party suppliers (the “Suppliers”) to arrange transportation, lodging, and all other services related to your travel. You agree to abide by the terms and conditions of purchase imposed by any Supplier with whom components of your travel package are booked. Further, you agree with the Supplier’s rules and restrictions regarding availability.

For certain accommodations, the price of your package has been converted from a different currency for convenience purposes to provide you an estimate of the amount of the purchase in US dollars. As a result, when you book, the amount charged to your credit card by the Supplier may be slightly different due to currency fluctuations. Your statement may also include a fee from your card issuer to process the transaction plus any applicable taxes for international purchases.

 

Pre-Existing Medical Conditions/Persons with Disabilities

It is essential that you advise us before booking if you do have any disability or pre-existing medical condition which may affect your travel, or if you have any special requirements as a result of any disability or medical condition (including any which affect the booking process) so that we can assist you in considering the suitability of the arrangements and/or in making the booking. Bee the Wellness will communicate requests to Suppliers but cannot be responsible if American with Disabilities Act (“AD”) accommodations are not available. Outside of the United States ADA (or similar laws and regulations) may not be in place and/or enforced.  You cannot expect ADA to apply to your travel accommodations outside of the United States. If additional services are needed and requested, Bee the Wellness cannot guarantee accommodations will be available to meet your request/s. And any accommodation options provided will be at the sole expense of the client requiring the accommodation.

Our Suppliers are, unfortunately, unable to offer additional assistance to clients with limited mobility and all such assistance will need to be provided by whoever the client is traveling with. Clients with disabilities must notify Bee the Wellness at the time of booking of status and of the identity of their non-discounted, paid travel companion who will be responsible for providing all necessary assistance. We may request that you provide a letter from your doctor confirming your fitness to travel.

 

Cancellations

Bee the Wellness  is required to pay Suppliers well in advance of your travel dates.  This includes but is not limited to hotel accommodations, medical care, transportation, etc.

 

Cancellation 30+ Days Prior to Arrival.

Upon receipt of your final payment, cancellations will be permitted up to 30 days prior to arrival date listed on your final itinerary for a full refund. Should you wish to cancel or reschedule your travel before 30 days prior to arrival, please contact us immediately so we can make the proper adjustments to your travel arrangements.

 

Cancellation Within 30 Days Prior to Arrival.

Within 30 days of your arrival date, we will refund any and all fees that we are able to recoup from the Suppliers. Should the Suppliers not permit refunds, we will not provide you with a refund. Our planning fees are always non-refundable at time of purchase. Should a cancellation become necessary, please inform Bee the Wellness immediately in writing and request a written confirmation of your cancellation. For refunds for any other services, you booked outside of Bee the Wellness, please refer to their Terms and Conditions for the applicable refund policy and contact them directly to cancel and to inquire about a possible refund. If you choose to reschedule, you will be subject to any Supplier change fees and increases in accommodation pricing. All arrangements will also be subject to availability for the newly proposed dates of travel.

All airline tickets purchased separately by client in conjunction with client’s travel are subject to separate airline penalties, per individual carrier’s rules and regulations for which we shall not be liable.  

If the reason for cancellation is covered under the terms of your travel protection plan you may be able to reclaim these charges, for this reason we strongly encourage the purchase of a travel protection plan including additional cancel for any reason coverage.

 

Cancellation by the medical service provider.

In the event the medical service provider chooses to change the procedure date, the standard cancellation schedule remains effective for the original departure date. Cancellation of a medical travel without Bee the Wellness’ consent is subject to standard cancellation charges.

 

Cancellation by Bee the Wellness.

We reserve the right to cancel or reschedule any departure for any reason. If we cancel, except in the case of a force majeure event, we will offer alternate arrangements.  If no suitable alternatives can be found, we will provide a full refund.  Client is responsible for any additional costs for air tickets or other travel arrangements not made by us.

 

Force Majeure

Bee the Wellness assumes no liability for, any loss, damage, delay, or cancellation resulting in whole or in part from an Act of God or any other force majeure condition, including, without limitation: fire, volcanic eruption, hurricane, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labor disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, epidemics, pandemics, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorization, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by Bee the Wellness  that impacts negatively on, or hampers, its ability to fulfill any of its contractual conditions. In the circumstances amounting to Force Majeure, we will not be required to refund any money to you, although if we can recover any monies from our Suppliers, we will refund these to you without any charge by Bee the Wellness.

 

Non-Responsibility

Bee the Wellness does not provide, own, manage, operate, supervise, or control any transportation, vehicle, hotel, travel services, products or any other entity (Supplier) that supplies services related to your travel, including but not limited to, flights, accommodations, meals, packages, travel insurance, medical facilities, medical professionals, etc. (the “Travel Products:).  The Travel products are owned, controlled, or made available by third party Suppliers. such as airlines, hotels, operators and owners, trip operators, medical facility providers and medical professionals. The Suppliers are responsible for the Travel Products. Bee the Wellness is an independent contractor and is not an employee, agent, or representative of any of these Suppliers. All Suppliers are independent contractors and are not agents or employees or representatives of Bee the Wellness.

The Supplier’s terms and privacy policies apply to your booking so you must agree and understand those terms. All tickets, receipts, reservations, and vouchers are issued subject to the terms and conditions specified by each Supplier, and by accepting such, or utilizing the services, all clients agree that neither Bee the Wellness, nor its employees, agents, or representatives are or may be liable for any loss, injury, or damage to any travel client or their belongings, or otherwise, in connection with any service supplied or not supplied resulting directly or indirectly from any occurrence beyond the control of Bee the Wellness. Bee the Wellness assumes no responsibility or liability for any delay, change in schedule, loss, injury or damage or loss of any client that may result from any act or omission on the part of others. Bee the Wellness accepts no responsibility for lost or stolen items. Your interaction with any Supplier is at your own risk; Bee the Wellness does not bear any responsibility should anything go wrong with your booking or during your travel.  Hence, as a client, you agree that Bee the Wellness acts only as agent for client in acquiring transportation, hotel accommodations, access to medical facilities and professionals and other privileges or services for your benefit, and on the express condition that Bee the Wellness shall not be responsible for any loss, accident, injury, delay, defect, omission or irregularity which may occur or be occasioned, whether by reason of any act, negligence or default of any company or person engaged in or responsible for carrying out any of the arrangements, or otherwise in connection therewith.

Bee the Wellness reserves the right to refuse any client or potential client at its sole discretion.

 

Assumption of Risk

Client is aware that all travel involves inherent risks outside of the comfort of staying at home, and that medical travel has additional risks. Inherent risks include, but are not limited to, hazards of receiving medical treatment outside of the United States and any and all complications arising from said treatment, risk of injury or death from medical treatments, risk of injury or death from: motor vehicles collisions, animals, roadway hazards, slips, and falls, criminal or terrorist acts, government actions, consumption of alcoholic beverages, tainted food, or non-potable water; exposure to the elements, including heat, cold, sun, water, and wind; your own negligence and/or the negligence of others, including Suppliers, Bee the Wellness and its employees, agents and/or representatives; attack by or encounter with insects, reptiles, and/or animals; accidents or illness occurring in places where certain medical services are limited or less advanced; fatigue, chill, overheating, and/or dizziness; known or unknown medical conditions, physical excursion for which you are not prepared or other such accidents; the negligence or lack of adequate training of any third-party providers who seek to assist with medical or other help either before or after injuries have occurred; accident or illness without access to means of rapid evacuation or availability of medical supplies or services; and the adequacy of medical attention once provided.

Client understands the description of these risks, is not complete and that unknown or unanticipated risks may result in injury, illness, or death.  In order to partake of the enjoyment and excitement of this trip, Client is willing to accept the risks and uncertainty involved as being an integral part of travel, including the risk of infection, illness, and death. Client hereby accepts and assumes full responsibility for any and all risks and agrees to and shall hold harmless and fully release Bee the Wellness from any and all claims associated with the trip, including any claims of third-party negligence and/or the negligence of Bee the Wellness and Client hereby covenant not to sue Bee the Wellness for any such claims or join any lawsuit or action that is suing Bee the Wellness. This agreement also binds your heirs, legal representatives, and assigns.  The terms of this HOLD HARMLESS AND RELEASE OF ALL LIABILITY paragraph, shall survive any termination or cancellation of this Contract, whether by operation of law or otherwise.

 

Travel Documents and Destinations

By offering reservations for medical travel in particular international destinations, Bee the Wellness does not represent or warrant that travel to such areas is advisable or without risk. It is your responsibility to be aware of travel warnings and advisories as announced by the U.S. State Department as well as any and all COVID-19 restrictions and requirements.  Should you choose to travel to a country that has been issued a travel warning or advisory, Bee the Wellness will not be liable for damages or losses that result from travel to such destinations.

You and any minors traveling with you must be in possession of a machine-readable passport valid for 6 months after their trip return date along with applicable visas. Some countries require that your passport have two to four blank visa/stamp pages. Some airlines will not allow you to board if this requirement is not met.  For information about passport requirements, you can visit the State Department’s website at https://travel.state.gov/content/travel/en/passports.html.  It is your sole responsibility to secure and/or pay for any and all visas, reciprocity fees, affidavits, immunizations, etc. that are required to be permitted entry into each destination. In some countries you may be subject to entry (reciprocity) fees and/or departure taxes/ exit fees which will be collected at the airports upon entry/departure by local government authorities.  Please note that entry to any country may be refused even if the required information and travel documents are complete.

When travelling internationally, the U.S. Transportation Security Administration (TSA) and U.S. Department of Homeland Security (DHS) advise that everyone carry at least two forms of acceptable identification in order to board a flight. Examples: DHS designated enhanced driver’s license, USA Passport, a foreign government passport. The name, date of birth and gender that appears on the identification card must exactly match the same such data that is listed on airline ticket(s) and booking records.   For more information you can visit the TSA website at https://www.tsa.gov/travel/security-screening/identification.

For up-to-date detailed information on travel documents and visas, entry/exit taxes and further information on entry and exit requirements please check with your local consular services. Obtaining and carrying these documents is your sole responsibility. Bee the Wellness bears no responsibility for such information and will not be responsible for advising and/or obtaining required travel documentation for you, or for any delays, damages, and/or losses including missed portions of your vacation related to improper documentation or government decisions about entry.

Health: Recommended inoculations for travel may change and you should consult your health care provider for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to your trip. Inoculation requirements can be found on the Center for Disease Control website at https://www.cdc.gov/.

Recommended inoculations for travel may change and you should consult your practitioner for current recommendations before you depart. It is your responsibility to ensure that you meet all health entry requirements, obtain the recommended inoculations, take all recommended medication, and follow all medical advice in relation to the trip. Inoculation requirements can be found on your government’s health agency website.

 

Insecticide Notice

Clients are encouraged to check the list of countries that require airlines to treat the passenger cabin with insecticides prior to the flight or while on the aircraft on the U.S. Department of Transportation’s Web site, as this list is updated from time to time: http://www.dot.gov/office-policy/aviation-policy/aircraft-disinsection-requirements.

 

Travel Protection

It is the client’s responsibility to protect their purchases. For this reason, Travel Protection Coverage including additional cancel for any reason coverage is strongly recommended. Such plan should cover Trip Cancellation or Interruption, Medical Expense, Emergency Evacuation/Repatriation, and Baggage. Travel protection plans can help protect you in the event of loss of non-refundable trip deposits and payments that result from cancellation or trip interruption (due to a covered reason such as injury or illness before or during the trip). It also helps with reimbursement for medical emergency costs (including very costly medical evacuation costs), missed connections and baggage loss. Travel Protection Plans including cancel for any reason coverage must be purchased in close conjunction with your travel purchase.

Bee the Wellness is not qualified to answer technical questions about the benefits, exclusions, and conditions of travel insurance plans. Bee the Wellness cannot evaluate the adequacy of the prospective insured’s existing insurance coverage. If you have any questions about your travel protection, call your insurer or insurance agent or broker.

Certain countries have a requirement for foreign visitors to have valid medical insurance on entry. Bee the Wellness cannot be held responsible for denied entry if a client is unable to provide details to authorities of insurance or denial of entry for any reason. Declining to purchase an adequate travel protection plan could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without this coverage, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate coverage, we will not be liable for any of your losses howsoever arising, for which trip protection plan coverage would otherwise have been available.  

 

Indemnification

Client agrees to and shall indemnify and hold harmless Bee the Wellness, and each of our officers, directors, employees and agents (collectively “Bee the Wellness”), from any expenses, losses, liabilities, damages, judgments, settlements and costs (collectively, “damages”) involved with or incurred by Bee the Wellness (including, without limitation, reasonable attorneys’ fees and the advancement of same) with respect to any claims, law suits, arbitrations, or other causes of action, which result, directly or indirectly, from: (i) client’s breach or violation, or threatened breach or violation, of this Agreement and (ii) Any damage caused by client while participating in the trip.

 

Governing Law/Jurisdiction/Class Action Waiver/ Notice of Claim

This Agreement and all attachments hereto and the rights of the parties hereunder shall be governed by and construed in accordance with the laws of the State of Wyoming exclusive of conflict or choice of law rules. Any claims shall be brought in a court of competent jurisdiction located in Wyoming. You agree that you will only bring claims against Bee the Wellness in your individual capacity and not as a plaintiff or class member in and purported class action or representative proceeding. Bee the Wellness shall not in any case be liable for other than compensatory damages, and your payment of a deposit on a trip means that you agree to these conditions of sale and expressly waive any right to punitive damages. You understand and agree that no claims will be considered and that you will not bring suit against Bee the Wellness unless you have first provided a typewritten notice of claim to Bee the Wellness within 30 days after the trip or cancellation of the trip.

 

Entire Agreement & Severability

This agreement, including any other documents, including invoices, we provide you, and the terms and conditions of our Suppliers constitute the entire agreement, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, with respect to Bee the Wellness. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
